cp <Fat16, 400MB> <Fat16, 1,4GB> does not work

Hi,
(using Linux 2.2.14, GNU Parted 1.2.14)
 
cp <Fat16,400MB> <Fat16,1,4GB> does not work. That means: 

   cp 2 1

does not work with /dev/hda2 is FAT16 (about 400MB) and 
/dev/hda1 is Fat16 (about 1,4GB).  I already 
tested hda1: I formatted as Fat16 and I mounted 
this partition sucessfully. 


parted claims within   cp 2 1 : 
Warning: The file system can only be resized to this size by
converting to FAT32.  If you
convert to FAT32, and MS Windows is installed on this partition, then
you must re-install the MS
Windows boot loader.  If you want to do this, you should consult the
Parted manual (or your
distribution's manual).  Also, converting to FAT32 will make the file
system unreadable by MS
DOS, MS Windows 95a, and MS Windows NT.
OK Cancel ? c

Parted wants to convert to Fat32 ! Why? 
hda2 is not greater that 2 GB (=limit for FAT)! 

Reversed copying Fat16 (1,8GB) to a Fat16 (400MB) works fine
(if allocated data in 1,8GB partition is smaller than 400MB,of
course)!

Background information:

1. yesterday hda1 was Fat32. But I don't need it any longer. So 
   I converted it to Fat16 with fdisk. After I formatted hda1 
   with success.

2. #> fdisk -l
