Then just do:

 (progn (insert-before-markers (eval-when-compile
                                (propertize "\n" 'syntax-table '(0))))
 ...)

or change byte-opt.el to mark the `propertize' function with
`byte-optimize-pure-func' rather than with `side-effect-free'.
