Yes, you can test:
(condition-case nil
(substitute-in-file-name "C$/")
(error
...add the advice...))
writing it this way is also a good way to document why the advice is used.
Documentation in the form of code has the advantage over comments that it
doesn't have the same tendency to go stale.
