It's not a question whether I like it or not: it's faulty to assume a file starting with ``%!TEX´´ is a valid PostScript file!

I have file 4.02, and this version works correctly and reports 'ASCII text.' What else should it assume, since it does not know that Richard Koch made this signature (or header) an identifier for his TeXShop application, making it recognise the encoding (you probably have an idea of how many there exist) and the TeX dialect, i.e. which TeX programme (or engine in TeXShop terms) would be going to compile the document.

``%!TEX´´ is something private yet and not in the least related to any PostScript.
