That in itself is a misunderstanding of free software.  You can choose
not to distribute free software free of charge.  The requirement is that
when you do distribute it, whatever you charge, you also provide (in
most cases) equivalent access to the source code.

Legal stuff clearly can get in the way of allowing something to be free
software.
