Yep, the problem is reproducible on my machine:

200 harp1 GNATS server 4.0-beta1 ready.
expr (category="test") & (state="closed")
415 Invalid expression.
expr (category="test")&(state="closed")
210 Ok.

I'd suggest you write a summary and submit it to the GNATS database.
