Because:
 - it doesn't fix bug but workarounds it
 - changes the behaviour on which some user applications may depend
It's not ugly itself.

OK. So we'd have:
 --writephonebook with no options to not overwrite
 --writephonebook -o to overwrite
 --writephonebook -f to find the free entry.
It may be indeed a good compromise.
