Read the subpeana, stupid. Hint: "(d) DUTIES IN RESPONING TO SUBPOENA",

BTW, FSF's "GPL Compliance Lab" is run by non-lawyer(s)/non-attorney(s). 
It's run by "compilence engineer(s)" (my, what a perverse sense of humor) 
and hence it's not privileged irrespective of whatever Moglen claims.
