Why is this the only proof?
Does any case law support the use of such a test?

I would have thought that looking at the 5Cmaterial being distributed and
searching for copied elements would be a more common test.

Anyhow, I might write my own header file that happens to be compatible
(which is what the cygwin/mingwin developers did with the win32 API).
