Yeh ... If they first register them with the Copyright Office. . . which they have never done.

The general attitude among GPL developers, including the FSF, who
might be expected to be among the most severe enforcers, appears
to be that reinstatement comes with compliance. It's up to those
who want something different to identify themselves.

It up to the courts to rule on these matters. Did you mean psuedo
enforcers.
