You are confused.  The patent clause in the GPL does not regulate a part
of what is covered by copyright.  It spells out conditions you need to
fulfill in order to be granted the provisions of the GPL.  _All_ of
those conditions cover something not covered by copyright, or one would
not need to spell them out.  The GPL is "tit for tat", and it would
appear you have problems recognizing the tits.
