No, your memory was correct.  Scilab used to be released under a
non-free license.  Here's the web archive of their FAQ from 2007:

It's an interesting illustration of your point about the importance of
avoiding the term 'open source', since despite its license conflicting
with both the Free Software definition and the Open Source definition,
Scilab's slogan at the time was 'The open source platform for numerical
computation':
