Perhaps adjusting the system-system-spacing might work then. For instance, consider setting the 'padding value, which forces a minimum distance between the skylines of the neighboring systems. For systems that have no pedal marks, they shouldn't need to move assuming your 'basic-distance is set to a reasonable value, but then the ones that have the pedal marks will get too close and push the next system lower.
