Follow-up Comment #3, bug #52641 (project octave):

Actually, gnuplot is updating the "displayname" somewhere else too because I
can comment out all the lines of "updatename" listener and the "Legend String"
goes away.  So gnuplot toolkit is covering up the issue.

Anyway, I see what the issue is here.  The original error example works, but
not your second, simpler example.  But your second example uses the
"displayname" listener callback method.  However, if hplots is empty, the
legend string will not be updated:

    if (! isempty (hplots))
      legend (get (hplots(1), "parent"), hplots, text_strings);
