...and then nobody has any right to even posess Darwin, at least the versions
licensed under APSL 1.0 and 1.1.

Since the point seems to have sailed over your head, it means that Apple was
within its rights to revoke even the USAGE right to the code if someone even
made the CLAIM of patent infringement.

No, it's completely realistic to expect my own source to not be held hostage
by someone else's legal woes. Free software licenses (and all Open Source
licenses as well) live up to that expectation. APSL does not, even in the 1.2
version.
