another concern i had was that there seemed to be in this bill a means
of putting hypothetical value on downloads, even when there was no proof:
(2) The court may:
(i) award declaratory relief and other equitable remedies, including
preliminary and final injunctions to prevent or restrain violations of
this section, without requiring proof that the plaintiff has suffered,
or will suffer, actual damages, irreparable harm or lacks an adequate
remedy at law;
this seems to clear the way for calculating losses due to P2P downloads
by the number of files shared - which is always a misnomer. i am
assuming that the primary purpose of outlawing these 'communication
devices' is anti-P2P?
