I've signed the FSF copyright papers years ago, but keep in mind the theme has other contributors as well.
Anyways, I'll help however I can with the copyright stuff, provided you decide to move in that direction.

To the extent that the color choices of Solarized are _determined_ by
abstracted design goals, they are not copyrightable choices.  Only
details of _expression_ that could have been chosen differently are
copyrightable.  I don't know how much of that there is in Solarized.
If it is all decided based on what works well, maybe none of it is
copyrightable.
