Merci, merci... 

mais y'a rien de très spécial à en dire pour l'instant : la directive intégre
les amendements qui avaient été réclamées. Le principe reste celui de
l'impossibilité de brèveter un logiciel avec une exception quand ce logiciel
possède un effet technique. 

Mais, la définition de l'effet technique est précisée : 

5. Article 4a: Exclusions from patentability

4a.1. A computer-implemented invention shall not be regarded as making a
technical contribution merely because it involves the use of a computer, network
or other programmable apparatus. Accordingly, inventions involving computer
programs which implement business, mathematical or other methods and do not
produce any technical effects beyond the normal physical interactions between a
program and the computer, network or other programmable apparatus in which it is
run shall not be patentable.

4a.2. Member States shall ensure that computer-implemented solutions to
technical problems are not considered to be patentable inventions merely because
they improve efficiency in the use of resources within the data processing
system. 

Et le droit à l'interopérabilité est ensuite protégé, brevet ou pas brevet. 

Grosso modo les brevets sur les logiciels sont interdits en général, les brevets
sur les logiciels qui ont un effet technique sont autorisés mais ils sont très
limités et sans grand intérêt commercial (puisqu'ils n'empêchent pas l'interopé
rabilité). 

C'est donc plutôt bien tout ca :)
