It's on the list because it's still relevant. The current stable version of gNewSense is based on Ubuntu 8.04, which has the non-free version. The list doesn't prevent cracklib2 from being included in a free distro, it just serves as a warning for those creating free distros or individuals wanting to make their current installation more free.
