The OED gives examples of usage 4 dating back as far at 1668.  Here's
one from "The Tatler":

 1709 Steele & Addison Tatler No. 101 P 1 "These Miscreants are
 a Set of Wretches we Authors call Pirates, who print any Book,
 as soon as it appears..., in a smaller Volume, and sell it (as
 all other Thieves do stolen Goods) at a cheaper Rate.

There is even a quote from Daniel Defoe, the author of, in addition 
to "Robinson Crusoe", "A General History of the Pyrates":

 1701 "True-born Eng." Explan. pref. (1703) 6 "Its being Printed 
 again and again by Pyrates."
