It depends. Most of the time it is .clin_when. Sometimes it
is the time of the encounter to which something is linked.
At other times it is the .modified_when. Sometimes it can
even be mixed.

That choice has been made numerous times for different
queries, and has also been discussed on-list for some
instances of said choice.
