Nonetheless, according to File Exchange website terms of use:

Content submitted to File Exchange may only be used with MathWorks products.

While interpretations of this vary, it should be safe to use the code if you 
contact 
the author directly and have them send you the code personally.

Please don't submit code downloaded  from File Exchange for inclusion in Octave 
or Octave Forge,
even if you have applied extensive changes to the original version, unless you 
have contacted the author 
and received the code directly from him with an explicit consent to use it in 
Octave.
