Well, no, since I can't reproduce it in 21.4 either, which indicates
that it hasn't ever been a problem in the Emacs 22 code. Either I
misunderstood your report, or this is specific to your setup somehow.
Here are the steps I used:
1) emacs -q --no-site-file
2) (setq w32-swap-mouse-buttons t) ; to make mouse-2 accessible on my
2 button mouse
3) type some text in the scratch buffer and select it with the mouse.
4) Open a menu with the mouse and right click one of the menu items.
5a) Click on the menu normally to select an item and close the menu.
b) Repeat step 4 and click outside the menu to cancel it without
selecting an item.
No text was inserted in the scratch buffer by either these tests.
