    I'd publish it without bothering you, if the video didn't contain a
    banner specifying the *non-commercial* CC license -- at the bottom, for
    the full length of the video.  You explicitly asked to publish the video
    under CC-BY ND at the beginning of the video, so in my opinion the
    mistake was committed in good faith; however I don't think we should
    publish the video as it is.

I agree.  Let's contact the people who made the video and get this fixed.
