Mixing GPL open source with other licenses can be done.
However, it generally problematic as the terms and conditions of the GPL
are often violated either by convenience and/or misinterpretation.

I don't agree with your '... offer for the source' interpretation.
But then again I'm not a lawyer specializing in inter-jurisdiction (US
France EU) license issues.

In any case, the approach they have chosen to take seams suspicious.

Secondly, and perhaps more importantly, they did not contribute to the
OC project.

Anyway, my 0.02 Euros worth.
